1. Introduction
These Terms & Conditions (“Terms”) govern access to and use of the website www.olympuselitepay.com (the “Website”) and the concierge, brokerage, and elite services offered by OLYMPUS (Olympus Pay & Elite Services Ltd.) (“Olympus”, “we”, “our”, or “us”).
By accessing the Website or engaging Olympus for any services, you agree to be bound by these Terms. If you do not agree, you must refrain from using the Website or services.
2. Nature of Services
Olympus is a luxury concierge, brokerage, and facilitation company. We arrange, coordinate, and facilitate services provided by independent third-party providers, including but not limited to: - Private jet charters and aviation-related services - Ground transportation and logistics - Yacht charters - Accommodation, events, catering, and lifestyle services
Olympus does not operate aircraft, vessels, vehicles, or hospitality facilities unless expressly stated in writing.
3. Client Type
Olympus primarily services private individuals and private clients. Clients may elect to be invoiced through a corporate entity for accounting or tax purposes; however, the underlying engagement remains personal in nature unless otherwise agreed in writing.
4. Role of Olympus
Olympus acts strictly as an intermediary, broker, and facilitator. Actual services are delivered by independent third-party providers (“Service Providers”). Olympus is not a common carrier and does not assume the obligations or liabilities of a service operator.
Any contract for the delivery of services may be entered into directly between the client and the Service Provider, or between the client and Olympus acting on behalf of the Service Provider, depending on the specific transaction and documentation.
5. Relationship with OPES JET
Olympus Pay & Elite Services Ltd. is a wholly owned subsidiary of OpesJet Holdings Ltd. (UK). Notwithstanding this ownership: - Olympus and OPES JET operate as legally and operationally independent entities - Neither company assumes liability for the acts, omissions, debts, or obligations of the other - No partnership, agency, joint venture, or fiduciary relationship is created by ownership alone
Where services are provided across entities: - Olympus may contract OPES JET as a service provider (e.g. private jet charters) - OPES JET may contract Olympus for ancillary or concierge services
Access to Olympus services via OPES JET communication channels or platforms does not create contractual liability for OPES JET in respect of Olympus services, or vice versa.
6. Engagement and Communications
Clients may engage with Olympus directly via email, telephone, WhatsApp, or other communication applications, or indirectly through OPES JET communication channels, including OPES JET iOS and/or web-based applications.
All engagements are subject to confirmation by Olympus.
7. Pricing, Fees, and Payments
Pricing may include, without limitation: - Third-party service costs - Olympus service, facilitation, or brokerage fees - Commissions retained by Olympus - Banking, card processing, or currency conversion charges - Applicable taxes, duties, or levies (including VAT where applicable) - Insurance premiums or surcharges imposed by Service Providers - Governmental, airport, port, regulatory, or agency fees - Fuel surcharges, handling fees, and other operational costs
Olympus may receive payments from clients on behalf of Service Providers and may deduct agreed fees, commissions, and applicable charges. Unless otherwise stated in writing, all services require advance payment and, in many cases, full prepayment prior to confirmation.
Time for payment is of the essence. Olympus reserves the right to suspend, cancel, or withhold confirmation of services until payment is received in cleared funds.
8. Cancellations, Changes, and Refunds
All cancellations, amendments, and refunds are subject to the terms imposed by the relevant Service Providers and may vary by service, timing, and jurisdiction.
Olympus does not guarantee that any cancellation will result in a full or partial refund. Where refunds are possible, Olympus may deduct, without limitation: - Third-party cancellation charges or non-refundable costs - Olympus service, facilitation, or brokerage fees - Administrative costs, expenses, and time incurred - Banking, card processing, or currency conversion fees - Any losses reasonably incurred in reliance on the booking
In certain cases, no refund may be due. Any discretionary refund offered by Olympus shall be made strictly on a goodwill basis and does not constitute a waiver of these Terms or establish precedent.
Unless otherwise agreed in writing, the determination of refundable amounts rests solely with Olympus. Any decision by Olympus, including discretionary decisions made by the Chief Executive Officer or authorized representatives, shall be final and binding to the extent permitted by law.
9. Force Majeure and Prevailing Agreements
Olympus shall not be liable for any failure or delay in performance resulting from events beyond its reasonable control, including but not limited to weather conditions, technical failures, governmental actions, strikes, acts of God, conflict, war, sanctions, civil unrest, health emergencies, or supplier non-performance.
Where Olympus issues or is party to transaction-specific agreements, confirmations, charter contracts, booking terms, or service schedules, such documents shall prevail over these Terms & Conditions in the event of any conflict or inconsistency.
10. Client Responsibilities
Clients agree to: - Provide accurate, complete, and timely information - Comply with all applicable laws, regulations, sanctions, and governmental requirements - Ensure passengers or beneficiaries comply with legal, immigration, customs, health, and operational requirements - Accept decisions made by service operators, authorities, or captains in matters of safety, security, and compliance
Clients acknowledge that laws, regulations, sanctions, tariffs, fees, and border requirements may change at short notice and that compliance remains the sole responsibility of the client and any passengers.
11. No Advice, No Guarantee, and Risk Acknowledgement
Olympus does not provide legal, tax, immigration, customs, sanctions, or regulatory advice. Any information or guidance provided by Olympus is offered on a best-efforts basis for convenience only and must not be relied upon as professional or official advice.
Clients acknowledge and accept that: - Availability, routing, pricing, permissions, and outcomes are not guaranteed - Services may be affected by changes in law, sanctions, tariffs, fees, governmental action, conflict, war, civil unrest, natural disasters, health emergencies, or force majeure events - Entry, overflight, landing, or service permissions may be refused or withdrawn without notice
Olympus shall not be liable for losses, delays, cancellations, or costs arising from such circumstances.
12. Personal Data and Compliance
Clients acknowledge that Olympus may collect and process personal data including passport copies, billing details, and payment information to facilitate services.
Olympus is not generally required to conduct formal KYC procedures but reserves the right to request additional information where required by Service Providers, financial institutions, or authorities.
12. Limitation of Liability
To the maximum extent permitted by law: - Olympus shall not be liable for indirect, consequential, or special damages - Olympus shall not be liable for acts or omissions of Service Providers - Olympus’s total liability, if any, shall be limited to the fees paid directly to Olympus for the relevant service
13. Indemnity
You agree to indemnify and hold harmless Olympus, its directors, officers, employees, and agents from any claims, losses, or expenses arising from your breach of these Terms, misuse of services, or violation of applicable laws.
14. Intellectual Property
All content on the Website, including trademarks, branding, text, and materials, is the property of Olympus or its licensors and may not be used without prior written consent.
15. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Malta. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malta, unless otherwise agreed in writing.
16. Amendments
Olympus reserves the right to amend these Terms at any time. Updated versions will be published on the Website and take effect upon posting.
